An Order of Protection, commonly referred to as a restraining order, is a court order that can shield its recipient and their children from abuse or threats of abuse by someone they’ve had a close relationship with—like a spouse or romantic partner.
A typical Order forbids an abuser from hurting, threatening, or harassing the victim. The abuser will be forbidden to be in the physical proximity of the Order recipient, their children, their place of work, or residence. If an abuser violates an Order of Protection, he or she may be arrested.
It is important to note that an Order of Protection can be filed at any point in time. It is not tied to the divorce even if the need for it is triggered by the divorce.
